Define Forensic Medicine (Legal/State Medicine).
The branch of medicine that applies medical knowledge to assist in the administration of justice and the solving of legal problems, dealing with the application of medical facts to legal issues.
Who is regarded as the 'Father of Forensic Medicine/Legal Medicine'?
Paolo Zacchia (Italian), author of Quaestiones Medico-Legales (1621-1635). (Fortunato Fidelis is sometimes called the founder of legal medicine.)
Define Toxicology and name its 'Father'.
Toxicology is the science dealing with the properties, actions, detection, and treatment of poisons. Mathieu Orfila is regarded as the Father of Toxicology (author of Traité des Poisons, 1814).
Differentiate the scope of Clinical Forensic Medicine vs Forensic Pathology.
Clinical Forensic Medicine deals with examination of LIVING persons for legal purposes (assault, sexual offences, age, intoxication). Forensic Pathology deals with the DEAD (autopsy, cause and manner of death).
What is a subpoena and what does disobeying it constitute?
A subpoena is a written legal document/order compelling a person to attend court to give evidence or produce documents at a stated time and place. Willful disobedience constitutes contempt of court.
List the three main types of witnesses in court.
1) Common (ordinary) witness — states facts perceived by senses; 2) Expert witness — gives opinion on matters within their expertise; 3) Hostile witness — one who conceals truth or gives evidence against the party who called them.
Distinguish 'examination-in-chief', 'cross-examination', and 're-examination'.
Examination-in-chief: questioning by the side that called the witness (no leading questions). Cross-examination: questioning by the opposite party (leading questions allowed) to test credibility. Re-examination: by the side that called the witness, to clarify doubts raised in cross-examination.
What is 'Dying Declaration'?
A written or oral statement of a person who is dying, concerning the cause and circumstances of their injury/death. It is admissible as evidence (exception to hearsay) on the principle 'a dying person never lies' (nemo moriturus praesumitur mentire).
Differentiate 'Dying Declaration' from 'Dying Deposition'.
Dying Declaration: recorded usually by a magistrate/doctor/police, not on oath, no cross-examination, victim need not be under expectation of death (in some jurisdictions). Dying Deposition: recorded by a magistrate on oath in presence of the accused, who has the right to cross-examine; it carries more evidentiary value.
Define the standard of proof: 'beyond reasonable doubt' vs 'balance of probabilities'.
Criminal cases require proof 'beyond reasonable doubt' (near certainty). Civil cases require proof on the 'balance/preponderance of probabilities' (more likely than not).
What are the four elements required to prove medical negligence (the '4 Ds')?
Duty (of care owed), Dereliction (breach of that duty), Direct causation, and Damage (harm resulting). All four must be established.
State the 'Bolam test' in medical negligence.
A doctor is not negligent if they acted in accordance with a practice accepted as proper by a responsible body of medical opinion skilled in that particular art.
Differentiate 'Res Ipsa Loquitur' from 'contributory negligence'.
Res ipsa loquitur ('the thing speaks for itself') applies when the injury could not have occurred without negligence, shifting the burden to the doctor (e.g., swab left in abdomen). Contributory negligence is when the patient's own failure to follow advice contributes to the harm.

What is 'informed consent' and at what age can a person generally give valid consent for a general physical examination?
Informed consent is voluntary agreement given after being told the nature, risks, benefits, and alternatives of a procedure. Generally, a person 12 years or above can give consent for a general examination; for major procedures/treatment the age is usually 18 years.
What is a Medico-Legal Case (MLC)? Give three examples.
An MLC is any case of injury or illness where attending physician, after eliciting history and examination, thinks that investigation by law enforcement is required to fix responsibility. Examples: assault, road traffic accidents, poisoning, burns, suspected homicide/suicide, sexual offences.
Define death (somatic/systemic death).
Somatic death is the permanent and irreversible cessation of the functions of the brain, heart, and lungs (the tripod of life). Molecular/cellular death follows, being death of individual cells occurring hours later.
What is 'brain death' and the significance of the 'Harvard criteria'?
Brain death is irreversible cessation of all functions of the entire brain including the brainstem. The Harvard criteria (unreceptivity, no movements/breathing, no reflexes, flat EEG) are used to certify brain-stem death, important for organ transplantation.
List the immediate signs of death.
Cessation of circulation (absent heartbeat/pulse), cessation of respiration, and loss of nervous system function (loss of consciousness, reflexes, and muscle tone).
Define Algor Mortis and state the approximate average rate of body cooling.
Algor Mortis is the cooling of the body after death. In temperate climates the body cools by roughly $1.5\,^\circ\text{F}$ (about $0.83\,^\circ\text{C}$) per hour for the first few hours after death.

Livor mortis is the bluish-purple discoloration of dependent parts of the body due to settling of blood after circulation stops. It begins within 1-3 hours, fixes by 6-8 hours, and helps estimate time since death and whether the body was moved after death.
