State the Golden Rule of interpretation and when it is applied.
The Golden Rule allows departure from the literal meaning to avoid an absurd, inconsistent or repugnant result; it is applied when the literal rule produces an absurdity.
State the Mischief Rule (Heydon's Case) of interpretation.
Under the Mischief Rule (Heydon's Case, 1584), the court examines the law before the Act, the mischief/defect not covered, the remedy provided, and interprets the statute to suppress the mischief and advance the remedy.

Internal aids are found within the statute itself (title, preamble, definitions, headings, provisos, etc.); external aids lie outside the statute (parliamentary history, dictionaries, prior law, etc.).

Long and short title, preamble, definition/interpretation clauses, headings and marginal notes, provisos, illustrations, explanations, schedules, and punctuation.

The Preamble expresses the general object, scope and purpose of the Act and can be used to resolve ambiguity, though it cannot override clear and unambiguous enacting provisions.

'The express mention of one thing excludes others' — when a statute expressly mentions certain things, items not mentioned are deemed to be excluded.
What is the presumption of constitutionality in statutory interpretation?
There is a presumption that a statute enacted by the legislature is constitutional and valid; the burden lies on the person challenging it to prove otherwise, and courts lean in favour of upholding the law.
What this deck covers
